Our Firm represents commercial as well as not-for-profit entities in various industries, including technology, bioscience and health care, real estate, equipment and aircraft finance and leasing, hospitality, fashion, venture capital, insurance, banking and finance, retail businesses and professional services providers.
MANAGEMENT LIABILITY INSURANCE PRACTICE (Directors and Officers Liability)
Our Firm assists clients in evaluating, negotiating and enforcing their directors and officers (D&O) and other management liability insurance policies. Our clients range from companies to management to individuals seeking independent assistance with their D&O insurance programs.
Our Firm assists clients in evaluating such policies and suggests coverage enhancements and drafts language for requested endorsements. If requested, we also work with our clients' insurance broker to negotiate selected coverage enhancements using our knowledge of the market in this area.
In addition, our Firm can assist clients in best positioning a claim to ensure maximum potential insurance recovery. Starting with the decision of whether to put insurers on notice of a claim or a circumstance, and continuing through the negotiation and structuring of a settlement agreement, we can advise on how to optimize the potential for coverage. We also counsel on issues such as rescission, severability, the applicability of exclusions, and how to respond to reservation of rights and coverage denial letters. We also work with our client's litigation counsel in any litigation proceedings in order to maximize insurance recoveries.
